Terms of Use

The Australian Museum Trust, trading as the Australian Museum, is the owner of a number of trademarks (both registered and unregistered), logos, designs or assets (AM IP).

By using any AM IP, you accept and agree to comply with the terms:

2.1. set out in the Brand Guidelines relating to the AM Logo;

2.2. in any contract or arrangement authorising you to use AM IP; and

2.3. these Terms of Use.

You are not permitted to use the AM IP in a manner that implies that AM has sponsored or endorsed your use without the express written permission or licence from AM.

You also acknowledge that AM may take legal action against unauthorised or infringing use of AM IP or use of the AM Logo that does not conform to the Brand Guidelines.

AM is the sole owner of the AM IP, and you will not challenge or interfere with AM’s rights in any them, including challenging AM’s use and registration of its trademarks anywhere in the world.

You will not use or apply to register any of the AM trademarks in any jurisdiction, in part or in whole, or anything confusingly similar to the AM trademarks, as a trademark, service mark, company name, trade name, domain name, or social media handle, profile, wallpaper, etc.

You will not harm, misuse, disparage, or dilute the AM IP or tarnish AM’s goodwill in it. Examples of misuse include: altering authorised colour schemes and/or fonts, re-scaling, combining the AM IP with other logos or graphics contrary to the Brand Guidelines, obscuring, animating or otherwise distorting or manipulating the integrity of the trademarks or logos.

All goodwill associated with your use of the AM IP will enure exclusively to the AM.

Except for the limited right to use the AM IP for the specified purposes under these Terms of Use, no other rights are granted, by implication or otherwise.

Your use of the AM IP, if not set out in a separate agreement with the AM, can be revoked at any time by the AM in its sole discretion.

These Terms of use are governed by the laws in New South Wales, Australia and subject to the exclusive jurisdiction of the courts of that place without regard to conflict of law principles.

The AM Logo is a registered trademark of the Australian Museum Trust, trading as the Australian Museum.

The AM may modify the Brand Guidelines at any time at its sole discretion.

AM provides the Brand Guidelines “as is” and disclaims any warranties either expressed or implied by law regarding AM’s Logo, including warranties of non-infringement.
