Terms and conditions


  1. Information on how to enter this customer survey competition (“Promotion”) and prize details form part of these conditions. Entry into this competition is deemed acceptance of these terms and conditions of entry.
  2. The Promoter is Australian Museum (ABN 85 407 224 698) 1 William St, Darlinghurst NSW 2010 (“Promoter”).
  3. The Promotion period begins at 11am AEDT 03/12/2021 to 6pm AEDT 19/12/2021 (“Promotion Period”).
  4. The Issuer is Fiftyfive5 (ABN: 87 142 679 221), 44 Bay Street, Ultimo, Sydney, NSW 2007, Australia (“Issuer”).
  5. Entry is open to Australian residents, aged 18 years and over who receive a survey from the Promoter and complete the survey, and record a short video with the Issuer’s fieldwork partner, except for persons employed by other agencies, firms or companies associated with the Promotion (including suppliers of prize), and their immediate families (“Eligible Entrants”).
  6. Only one (1) entry is permitted per person.
  7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  8. If there is any dispute as to the identity of the entrant, the Promoter reserves the right to, in its sole discretion, to determine the identity of the entrant or disqualify the entry where verification is not possible.
  9. In order to enter the competition, participants need to, during the Promotion Period:
    1. Record a short 1 minute clip to describe their experience at the Australian Museum;
    2. E-sign their permission and enter a valid email address for the Issuer to Promoter to contact the winner.
  10. The information entrants provide will be used by the Promoter (or Issuer on the Promoter’s behalf) for the purpose of conducting this Promotion, distributing the prizes and may also be used for the purposes specified in the Promoter’s privacy statement. The Promoter may disclose entrants’ personal information to companies and agencies connected with this Promotion, for the purpose of carrying out the Promotion. The Promoter’s privacy statement is available on the Promoter’s website: https://australian.museum/privacy/. The Issuer’s privacy policy is available: https://fiftyfive5.com/privacy-policy/. Each Privacy Policy/Statement also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  11. Total prize pool for is valued at AUD $200.00 and consists of 1x Voucher to use at the Australian Museum gift shop in store and online. The Voucher is subject to the terms of use for promotional vouchers. The Voucher should be treated like cash as it cannot be replaced with lost or misplaced.
  12. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
  13. Any ancillary costs associated with redeeming the prize are not included.
  14. This is a game of skill; chance plays no part in determining the winner.
  15. The judging will take place at 44 Bay St, Ultimo, 2007 between 10/01/2022 – 14/01/2022 AEDT.
  16. Each entry will be individually judged based on:
    1. Creative and relevant content contained in the video response to the question;
    2. The allocation of the prize and the criteria for assessing the entries will be based on the response being original, articulate, and of a high quality.
    3. Entries will be judged by a panel of judges from the Issuer and Promoter. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. The final decision is at the complete discretion of the Promoter and the judges. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
  17. The winners will be notified on or before 21st January 2022 by the email given at the end of this survey. If an email address is not given or not correct, the entry will not be valid.
  18. The best valid entry as determined by the judges will win the prize.
  19. The prize winners must claim their prize by 28th January 2022 (“Prize Claim Date”).
  20. If a winner does not claim the prize by the Prize Claim Date or the entry is deemed invalid, the prize will be forfeited and the next best entry, as determined by the judge(s) shall be awarded the prize and notified by 4th February 2022 as per notification method in Clause 17.
  21. The Prize, or any unused portion of the prize, is not exchangeable and cannot be taken as cash, and no change will be given, unless otherwise specified.
  22. The Promoter and its associated agencies and companies will not be liable for any damage to or delay in transit of the prize. Please allow up to six weeks for delivery of the prize.
  23. Entrants agree that they are fully responsible for any materials they submit via the Promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
    1. the Content is the original literary work of the entrant that does not infringe the intellectual property or other rights of a third party;
    2. they will not submit any Content that is unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in the Promoter’s opinion, is inappropriate or objectionable;
    3. their Content shall not contain viruses or cause injury or harm to any person or entity;
    4. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    5. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
    Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  24. Incomplete or indecipherable entries will be deemed invalid.
  25. If due to any reason whatsoever the Promoter becomes aware that a winner has not complied with any of the Promotion’s terms and conditions, that winner will have no entitlement to the prize, and will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
  26. Entrants agree that ownership of any intellectual property rights in their entry, is assigned to the Promoter without the payment of any further fee or compensation. Entrants agree to sign any further documentation required by the Promoter to give effect to this arrangement as a precondition to being awarded their prize.
  27. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28. The Promoter accepts no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
  29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  32. The Promoter reserves the right to change these terms and conditions at any time. If any changes are made the Promoter will notify the public via its website.
